
Mumbai, 6th October 2026: The Bombay High Court has set aside a Maharashtra Real Estate Appellate Tribunal (MahaREAT) order that had restored the residential status of the long-delayed Turf View project in Mumbai’s Mahalaxmi, clearing a regulatory hurdle for its proposed redevelopment. The court’s decision came after the parties informed it that they had amicably resolved their disputes.
A single-judge bench of Justice N J Jamadar passed the order on September 29, setting aside the August 25, 2026, MahaREAT decision. The earlier tribunal order had overturned MahaRERA’s approvals relating to the project’s change of promoter and subsequent de-registration.
The dispute dates back to 2007, when an associate company of DB Realty launched the Orchid Turf View luxury residential project in Mahalaxmi. Several homebuyers had booked apartments and paid around 50% of the consideration. They later alleged that agreements for sale were not executed, the project remained incomplete and possession was not handed over.
The developers subsequently sought to change the project from residential to residential-cum-commercial and transfer development rights to Turf Estate Joint Venture LLP, involving DB Realty and the Prestige Group. MahaRERA approved the promoter change in October 2021 and allowed the project to be de-registered in September 2022.
Four allottees challenged these decisions before MahaREAT, which restored the project’s residential status in August. Following the High Court ruling, the earlier MahaRERA decisions now stand restored, allowing Prestige Estates Projects and Valor Estate, formerly DB Realty, to proceed with their planned residential-cum-commercial development overlooking the Mahalaxmi Race Course.
